You understand and agree that Zworg's services are provided to registered users exclusively under Zworg's Terms of Service. By completing the registration process you are stating that you are 18 years or older or a minor who has parental permission to open and maintain an account, that you have read and understand the Terms of Service, and that you agree to be bound by the Terms of Service.

Security and Password:

You are responsible for maintaining the confidentiality of your account name and/or password. You are responsible for all uses of your account, whether or not authorized by you. You agree to immediately notify Zworg of any unauthorized use of your account.

Privacy:

It is Zworg's policy to respect the privacy of its members. Zworg will not disclose any individual user's name, email address, or other personal information without such user's prior written consent, unless Zworg has a good faith belief that such action is necessary to: enforce these Terms of Service, conform to legal requirements or comply with legal process, protect and defend the rights or property of Zworg, or act to protect the interests of its members or others. Zworg reserves the right to access your account, including its contents for the reasons stated above or to respond to service or technical issues.

Termination:

Zworg reserves the right to terminate any user's account if Zworg learns that such user has provided Zworg with false or misleading registration information or has violated the Terms of Service. Zworg may modify or discontinue its services or any user's account with or without notice to any user, without liability to any User or any third party. In addition, user accounts that are not accessed at least twice in the two weeks following registration and at least once every three months thereafter will be terminated.

Liability:

Zworg.com services are provided "as is." Use of any of Zworg's services are at your sole risk. Any material and/or data downloaded or otherwise obtained through the use of Zworg's services is at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data. You agree to indemnify, defend and hold harmless Zworg, its affiliates, officers, directors employees, consultants and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from your use of Zworg's services, your violation of the Terms of Service or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. Zworg assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store email messages. Zworg does not represent or warrant that this service will be uninterrupted or error-free, that defects will be corrected, or that the Service or the server that makes it available, are free of viruses or other harmful components. Zworg.com does not warrant or represent that the use or the results of the use of this service or the materials made available as part of this service will be correct, accurate, timely, or otherwise reliable.

User Conduct:

As a condition of your use of Zworg, you warrant to Zworg.com that you will not use the service for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

Zworg is provided to individuals only and for personal use only. You agree to use the service only to send and receive personal messages. Any unauthorized commercial use of the service, or the resale of its services, is prohibited. You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your account or password, including the content of your transmissions through the Service. By way of example, and not as a limitation, you agree not to:

Use Zworg in connection with surveys, contests, pyramid schemes, chain letters, junk e-mail, spamming or any duplicative or unsolicited messages (commercial or otherwise). Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

Publish, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful material or information.

Advertise or offer to sell or buy any goods or services for any non-personal purpose.

Harvest or otherwise collect information about others, including e-mail addresses, without their consent.

Create a false identity for the purpose of misleading others as to the identity of the sender or the origin of a message.

Transmit or upload any material that contains viruses, trojan horses, worms, time bombs, cancelbots, or any other harmful or deleterious programs.

Transmit or upload any material that contains software or other material protected by intellectual property laws, rights of privacy or publicity or any other applicable law unless you own or control the rights thereto or have received all necessary consents.

Interfere with or disrupt networks connected to the Service or violate the regulations, policies or procedures of such networks.

Attempt to gain unauthorized access to Zworg, other accounts, computer systems or networks connected to Zworg, through password mining or any other means.

Interfere with another member's use and enjoyment of Zworg or another individual's or entity's use and enjoyment of similar services.

Modification of Terms of Service and Member Polices:

Zworg reserves the right to alter the terms of service and member policies at any time. Zworg will make these changes available for viewing though the Zworg site and it is the sole responsibility of the user to review these changes. Continued use of Zworg's services indicates your consent to any changes.
